Coronavirus update - June 2020
To safeguard you, our instructors and other students while COVID-19 remains a threat it will be necessary to abide by the following additional terms and conditions. These terms and conditions are designed to help reduce the risk of contracting or transmitting the virus while taking driving lessons. Where there is any conflict between our standard terms and conditions of service and those listed below, these take precedence.
1. What are the risks of contracting COVID-19
COVID-19 is an extremely contagious disease that can lead to severe illness and in some cases death. We will do our best to minimise the risk to you by sanitising those surfaces that you might touch and by ventilating the car whenever possible before each lesson. Due to the fact we will not be able to observe the 2 metre social distancing rule while in the car, and because we will be operating in a confined space used by a number of different people, we are unable to guarantee you will not be infected by COVID-19 during your driving lessons.
2. Accept full responsibility should you or a member of your household become infected
By undertaking driving lessons with PDS you are agreeing to • accept full responsibility (except where we are negligent) for any loss, cost or expense you might incur should you contract COVID-19 or pass it on as a result of taking driving lessons with PDS. • not take any action against PDS or your instructor to recover any such loss, cost or expense.
3. Consider whether you or a member of your household might be particularly vulnerable
If you or any persons you are likely to be in contact with are at risk of having a severe form of the illness as a result of being infected by COVID-19 (e.g. senior citizens, pregnant women and those with underlying medical conditions) please consider very carefully whether you should be taking a course of driving lessons at this point in time.
4. Immediately let your instructor know if you or any members of your household have been exposed to serious risk of contracting COVID-19, tested positive for it, advised to self-isolate or shown symptoms of it.
If you know you may have potentially been in a situation where you or any member of your household may have contracted COVID-19, been tested positive for it, advised to self-isolate (e.g. NHS Test and Trace or equivalent) or shown symptoms (see below) it is vital that you let your instructor know as soon as possible. Please note, we do not need personal details of any individual to whom this may relate.
COVID-19 symptoms include:
• a high temperature (38C or above) • a new, continuous dry cough • unexplained loss or change to your (or their) sense of smell or taste This list is not exhaustive. For the latest information please refer to the Government guidelines or refer to https://www.nhs.uk/conditions/coronavirus-covid-19/check-if-you-have-coronavirus-symptoms/ Without charge to you this will help your PDS instructor to decide whether it will be necessary to postpone any future lessons until it is safe to continue based on the latest Government guidelines. Should your instructor discover you could have given them more notice of this they reserve the right to charge you for any driving lessons postponed.
5. Be prepared to answer truthfully any questions your instructor might ask before any driving lesson about potential COVID-19 exposure or symptoms
They may need to ask you questions about whether you have been in contact with people: • who might be infected (e.g. advised to self-isolate) or • who might have recently returned from abroad or • who you know are definitely infected or • who are particularly vulnerable to a severe form of the COVID-19 illness (also see 3 above). Your Instructor will also need to ask you about whether you or indeed anyone else in your household have experienced symptoms (see 4 above). In this regard they may need to take your temperature using a non-contact thermometer. Please note they do not need personal details of any individual to whom the above may relate. Without charge to you, your instructor reserves the right to postpone the lesson if they suspect you may have symptoms consistent with being infected by COVID-19 or have been seriously exposed to it until it is safe to continue based on the latest Government guidelines. Should they discover you could have given them more notice of this information they reserve the right to charge you for any driving lessons postponed as a result.
6. Reciprocal information about your instructor and the need for action regarding points 4 to 5
Your instructor will inform you if they suspect that they or anyone in there household have: • been exposed to a serious risk of contracting COVID-19 or • tested positive for COVID-19 or • exhibited symptoms of COVID-19 infection or • been advised to self-isolate. If so, they may need to postpone your driving lessons (including attending any driving test) and self-isolate, based on current Government advice, for at least 14 days or indeed longer in the case of a severe infection. In this instance any scheduled lessons would be carried forward until they are in a position to resume training.
7. Wear a face covering or mask during the lesson
The wearing of a face covering or mask is recommended if social distancing is not possible. Therefore, PDS will require you to wear a face covering or mask during the lesson. Please bring your own face covering or mask, which should be one that you feel comfortable wearing. This must not interfere with your ability to drive safely. Please notify your instructor at least 48 hours prior to any driving lesson if you do not have a suitable face covering or mask. They may be able to supply a disposable mask or a reusable mask at an additional cost. Your instructor reserves the right to postpone the lesson in this situation without charge. However, should insufficient notice be given and you turn up for a lesson without a suitable face covering or mask your instructor also reserves the right to postpone and charge for the lesson.
8. Endeavour to properly wash your hands and face just prior to each lesson
If at all possible, please wash your hands and face thoroughly with soap and water for 20 seconds immediately prior to attending a driving lesson. Your Instructor will still require you to sanitise/wash your hands, after fitting a face covering or mask and prior to entering the car, using a suitable product that they will supply for this purpose. If you can not do this for medical reasons you may be required to wear suitable gloves instead. your instructor will also make sure there hands are clean or suitably gloved as the case may be. At certain intervals it may be necessary for you to re-apply hand sanitiser or wash as they direct.
9. Avoid having to bring any extra objects to the driving lesson
Please be mindful not to bring any objects with you that may potentially be a carrier for COVID-19, if at all possible. You can bring your phone with you provided it is switched off and can be kept on your person. Anything that cannot be kept on your person will need to be placed in a plastic bag or container provided by your instructor for this purpose and returned to you at the end of the lesson.
10. Car ventilation
It is known that COVID-19 transfer is reduced in open spaces therefore your instructor may ventilate the car by keeping some of the windows open during the lesson. If this is not practical, they will endeavour to ventilate the car between lessons.
Main terms and conditions
The provision of training is subject to the acceptance of these terms and conditions.
1. Driving licenses and fitness to drive:
You must hold a current, valid driving license, provisional, full or international, and produce it on (or in advance of) your first lesson. You must be fit to drive with regard to legal and medical requirements. Your PDS instructor reserves the right to cancel any lesson at any time if the pupil is unfit to drive due to drink, drugs or prescribed medicine, fatigue or unfit for any other reason or condition that would cause his/her driving to be dangerous or illegal. In such circumstances the lesson fee will be payable.
2. Payments and Cancellation:
Tuition fees are normally payable in advance. Payment can be made by cash or cheque. Any cheque offered for payments that are subsequently refused by the bank will be subject to an administration charge of £15.00.
If either you or your instructor needs to cancel or re-arrange a lesson at least 48 hours notice will be required for single lessons of up to two hours duration. Longer lessons need a minimum of four days notice. Failure to do so will result in you being charged for the full cost of the lesson. Any money paid for in advance including test fees may be used to cover any costs incurred by failing to give notice.
If for any reason you are unable to pay in advance or on the day without prior agreement with your
instructor you will incur an extra £5 charge on your lesson.
Your instructor will do everything possible to ensure that your lessons start and finish on time, but reserves the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances, e.g., dangerous weather conditions or problems with the training car. In the event of postponement fees paid in advance will be carried forward.
When paying for a block booking of 10 hrs you are entering into an agreement with your instructor that you will complete the 10hrs of instruction at the discounted rate, if for any reason you cannot complete the 10hrs you can request a refund, you will be charged full price on the lessons that have been completed and refunded the difference. Block booking and advanced payments are valid for 6 months, after this time they expire and are invalid.
3. Bookings and Lesson duration
Your instructor will endeavor to maintain regular lesson slots at the same time each week to ensure continuity of learning, however, this cannot be guaranteed.
The minimum lesson period is one hour. If, for any reason, the instructor is late for the lesson he/she will make a concerted effort to inform the pupil of the estimated time of arrival. If the delay is greater than 15 minutes this time will be credited to the pupil and when possible the lesson will be extended by the time due – if this is not possible the extra time will be carried forward to the next suitable lesson.
4. Training Location:
All sessions will start and finish at the same location unless alternative arrangements are made in advance. The instructor will determine a location for practical lessons which ensures both the pupil’s and public safety – this means that the instructor may need to drive the pupil to and from the lesson location; this journey time forms part of the lesson as paid for.
5. Training vehicles:
Training vehicles provided by the school are taxed, insured for the purposes of driving tuition and the DSA driving test, fully roadworthy and fitted with dual controls.
Pupils who require tuition in their own vehicle must supply evidence from their motor insurer that the car is covered for lessons when being supervised by a professional instructor in return for payment; the car must also be taxed and hold a current MOT certificate where appropriate. If a pupil wishes to use there own car this must be agreed buy the instructor in advance. Lesson prices remain the same in any circumstance.
6. Driving tests and bookings
Your instructor is happy to book your theory test for you at no extra cost, however the pupil will need to pay the instructor the current DSA test fee in advance of the test being booked, ( ask your instructor for the current DSA fee.) If the pupil wishes to book there own Theory test they do so at their own risk. Your instructor and PDS are not liable if you use a method of booking that charges you a booking fee above the cost of the test.
Your instructor will book your practical test for you when it is agreed between pupil and instructor that the pupil is of a standard required to pass the UK driving test. The DSA test fee must be paid in advance to your instructor before the test will be booked. If the pupil decides to book a practical test of there own accord, there is no guarantee that the PDS instructor will agree to take the pupil to test. This could result in the pupil losing their test fee and unable to take the test, therefore we strongly advise against this.
Your instructor reserves the right to refuse use of a driving school vehicle for test if he/she considers that supplying a vehicle could cause a risk to the pupil, training car or public safety.
The booking period for the test will be based upon the instructor’s normal diary schedule. Depending on the time of the test this will require a minimum two hour booking and possibly longer.
While your instructor will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, he/she cannot be held responsible for vehicle failure that occurs during the test and is not liable for consequential loss.
Your instructor cannot be held responsible for test appointments cancelled by the DSA due to bad weather, sickness, staff shortages or other reasons. Such cancellations are beyond the control of your instructor and therefore the lesson fee and ‘use of car’ fee for the booked period will be charged. Your instructor will advise about claiming compensation from the DSA.
7. Last minute lessons
If a pupil is registered for last minute lessons and the pupil chooses to take the discounted lesson time but has a standard lesson booked within a seven day period after this time, the pupil is still bound to there standard lesson. Last minute lessons are there as extra learning and practice time over and above the normal training lessons set out for the pupil.
Any promotions offered are subject to availability and all T&C. All promotional prices are a limited time offer so please check with your instructor first. All promotions can not be used in conjunction with any other offer; this includes the ‘first hour free for new drivers offer’.
Any vouchers purchased are only valid six months from purchase date, if the voucher is for a course of lessons, then the first lesson must be completed before the six month date and subsequent lessons must be booked, however this does not mean the entire course needs to have been completed before the six month date.
10. Your rights:
These conditions do not affect any protection a student has under consumer legislation.
We reserve the right to change or alter any of the terms and conditions without notice, but will endeavor to inform pupils of any changes as soon as possible.
